Public Notice: LCPS seeks offer to purchase Teachers Memorial School

The Lenoir County Board of Education hereby gives notice that it plans to sell the property located at 500 Marcella Drive Kinston, NC 28501 (also known as the former TEACHERS MEMORIAL SCHOOL) via the upset bid process of G.S. 115C-518 and 160A-269.  The Board is seeking an initial offer to purchase from interested persons.  After an initial offer is made, the Board shall post notice of the offer, in accordance with G.S. 115C-518 and 160A-269.  The property is being sold "as is" and will be conveyed by special warranty deed.  The Board reserves the right to reject any and all offers at any time.  This the 15th day of June 2023.  

G.S. 115C-518. Disposition of school property; easement and rights-of-way.

a. When in the opinion of any local board of education the use of any building site or other real property or personal property owned or held by the board is unnecessary or undesirable for public school purposes, the local board of education may dispose of such according to the procedures prescribed in General Statutes, Chapter 160A, Article 12, or any successor provisions thereto. Provided, when any real property to which the board holds title is no longer suitable or necessary for public school purposes, the board of county commissioners for the county in which the property is located shall be afforded the first opportunity to obtain the property. The board of education shall offer the property to the board of commissioners at a fair market price or at a price negotiated between the two boards. If the board of commissioners does not choose to obtain the property as offered, the board of education may dispose of such property according to the procedure as herein provided…

G.S. 160A-269. Negotiated offer, advertisement, and upset bids.

A city may receive, solicit, or negotiate an offer to purchase property and advertise it for upset bids. When an offer is made and the council proposes to accept it, the council shall require the offer or to deposit five percent (5%) of his bid with the city clerk, and shall publish a notice of the offer. The notice shall contain a general description of the property, the amount and terms of the offer, and a notice that within 10 days any person may raise the bid by not less than ten percent (10%) of the first one thousand dollars ($1,000) and five percent (5%) of the remainder. When a bid is raised, the bidder shall deposit with the city clerk five percent (5%) of the increased bid, and the clerk shall re-advertise the offer at the increased bid. This procedure shall be repeated until no further qualifying upset bids are received, at which time the council may accept the offer and sell the property to the highest bidder. The council may at any time reject any and all offers.

A walkthrough of the property will be held Monday, June 26 at 9 am.
